AYCANE AG - General Terms and Conditions
1. Scope of Cover
The following General Terms and Conditions apply to all orders made through our online store.
2. Contractual Partner / Conclusion of Contracts
When you agree to purchase our products, you are entering into a purchase contract with AYCANE AG, Riedstrasse 5, 6330 Cham, Switzerland (hereinafter referred to as “AYCANE”), operator of the online store, www.aycane.com.

By listing our products on our online store, we are making a legally-binding offer to conclude a contract for these items. You can start by placing our products in your shopping cart, with no obligation to purchase. Before submitting your binding order you can also correct your information at any time by using the functionality available during the order process. The contract comes into effect when you accept the items in your shopping cart by clicking the Submit Order button. Immediately after submitting your order, you will receive a confirmation via e-mail.
If you have selected PayPal as your payment option, the contract will be concluded via PayPal the moment you confirm your method of payment.
The language used for the conclusion of contracts is German.
We do not save the text of the contract.
3. Prices and Payment Terms
Prices to be paid by the customer are in the currency indicated and are applicable at the time of the acceptance of the order by AYCANE.
The prices listed in the online store include value-added tax but do not include shipping costs (as a rule, AYCANE provides free shipping and displays this clearly in the respective fields of the online store) or (if applicable) import duties.
4. Payment
AYCANE takes payment for ordered products via credit card or debit card. AYCANE reserves the right to verify credit card or debit card payments before accepting the order. Accepted payment methods can be found on our website.
5. Delivery Terms
Delivery methods and the anticipated order delivery time can vary from country to country and are clearly indicated on the website. We only ship via shipping providers. Unfortunately, items cannot be picked up in person. We do not deliver to automated parcel terminals.
6. Reservation of Title
The goods remain our property until they have been paid in full.
7. Right of Revocation
The customer can terminate a contract and return every delivered item to AYCANE for any reason, provided the customer has informed AYCANE in writing within 14 days following delivery.
In order to inform AYCANE of such a return request and to start the return process, the customer must follow the return process as detailed under the Returns page on the website under AYCANE returns.
The product must be returned to AYCANE in its original condition, that is, undamaged, clean, and in its original packaging.
AYCANE offers a free pick-up service. Please note that express shipping is not permitted for returns/exchanges.
When arranging a return, you can find the contact phone number for the shipping company on the Returns page of our website, as well as on the returns instruction sheet included with your delivery.
As soon as AYCANE has been informed of the customer’s wish to terminate the contract, the amount debited by AYCANE will be refunded as quickly as possible, and in any case, within 30 days of receiving the ordered item/s at our warehouse.
8. Transport Damages
If the customer establishes that the ordered items were damaged during transport, the shipping company employee who made the delivery should be informed, and AYCANE’s customer service should be contacted by e-mailing support@aycane.com. Your warranty rights will not be affected if you do not inform the shipping company or AYCANE about the transport damages, but doing so will make it easier for AYCANE to file a claim with the shipping company or the transport insurance.
9. Warranty
Defects to items due to production or material defects are replaced by AYCANE free of charge. All additional warranty rights are hereby expressly excluded. The customer’s duties to inspect for and give notification of defects as well as the warranty period is governed by the legal provisions. Information about our products (descriptions, videos, images, etc.) do not guarantee the properties of the product. The assignment of warranty claims is excluded.
To be compensated for a warranty claim, the customer must inform our customer service department of the identified defect immediately by contacting support@aycane.com. If you neglect to do so, the products will be considered as approved. The delivery is considered as having been approved if no notification of defect is e-mailed to our customer service department within 8 (eight) days following delivery. All asserted claims are verified from time to time. The lifespan of AYCANE products varies, depending on the model, the materials used and the individual use of the product. Claims asserted due to defects that can be proven to be due to incorrect fit, normal wear and tear, exceeding the product’s lifespan or damage due to wrongful, inappropriate or neglectful use of or alterations to the products, are excluded from the warranty. Defects on products that were not obtained through the AYCANE website are also excluded from the warranty.
10. Liability
AYCANE can only be held liable for direct damages, and only when the customer can prove these damages are the result of gross negligence or illegal behavior on the part of AYCANE, its employees, or third parties acting on behalf of AYCANE. In any case, AYCANE’s liability is limited to the (purchase) price of the order/service in question.
AYCANE, its employees, or third parties acting on behalf of AYCANE are excluded from additional liability for any other type of damage. In particular, the customer does not reserve the right to request compensation for damages that were not sustained to the product itself.
11. Applicable Law and Place of Jurisdiction
Swiss law shall apply exclusively. This applicable law shall only apply to users insofar as the user is not deprived of protection that applies to them under the mandatory consumer protection legislation in their regular country of residence. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded. The competent court of Zug is responsible for disputes pertaining to or regarding these General Terms and Conditions.
12. Data Protection
AYCANE adheres to all data protection laws and uses data that can only identify the customer in accordance with the provisions under their privacy policy.
13. Final Provisions
Should any provisions of these General Terms and Conditions be ineffective, the remainder of this contract shall not be affected. The applicable law shall apply in place of the ineffective provision.
